Welcome to HVACProSales.com. By accessing, browsing, or purchasing from this website, you agree to the Terms & Conditions below (“Terms”). Please review them carefully before using our services.
1) Scope & Acceptance
These Terms govern your use of the HVACProSales.com website and related services (“Services”). By creating an account or placing an order, you confirm that you are at least 18 years old and capable of entering into a binding agreement, and you agree to comply with these Terms and applicable laws.
2) Product Categories
We offer products across: HVAC Equipment, HVAC Accessories & Supplies, HVAC Parts, HVAC Tools, Air Quality Systems, Plumbing & Water Heating, Refrigeration & Ice Machines, and Workwear & Safety.
3) Listings, Availability & Pricing
- Product specifications, images, pricing, and availability may change without notice.
- Some items may be marked Special Order or Call for Pricing due to manufacturer policies or market conditions.
- We reserve the right to correct errors or cancel orders affected by inaccuracies prior to shipment, with a full refund of any amounts paid.
- All prices are in U.S. dollars and exclude taxes, shipping, and any applicable surcharges unless stated otherwise.
4) Orders, Payment & Tax
- Your order is an offer to purchase; we may accept or decline at our discretion. Acceptance occurs upon shipment confirmation.
- Payment is due at checkout via accepted methods shown on the site (e.g., major cards, PayPal). Transactions are processed through PCI-compliant gateways.
- Sales/use tax is collected as required by law. Approved tax-exempt customers must provide valid documentation prior to purchase.
5) Fulfillment, Dropshipping & Risk of Loss
- Orders may ship from our facilities or directly from authorized distributors/OEMs. Packaging and branding may vary.
- Title and risk of loss transfer to you upon delivery to the carrier (FOB origin), except where prohibited by law.
- Please verify shipping address accuracy at checkout; delivery delays due to address issues may incur carrier fees.
6) Shipping, Freight & Inspection
- Shipping options and typical handling times are described on our Shipping & Returns page. Transit times are carrier-dependent.
- Freight/LTL deliveries (e.g., equipment) may require appointment delivery and access for a freight truck. Additional services (liftgate, inside delivery) may incur fees.
- Inspect upon delivery. Note any visible damage or shortages on the carrier’s delivery receipt and take photos. Report concealed damage promptly per the carrier’s policy.
7) Returns, Cancellations & RMAs
- Cancellations are possible before shipment. After shipment, standard return policies apply.
- Unless stated otherwise, the standard return window is 30 days from shipment. Items must be unused/uninstalled in original packaging with all accessories and documentation. Workwear must be unworn with tags attached. Custom or made-to-order items are final sale unless defective.
- Eligible returns may be subject to a restocking fee (e.g., 15%). Return shipping is customer-paid unless due to our error or a verified defect.
- Obtain a Return Authorization (RA) before shipping items back. Unauthorized returns may be refused.
8) Warranties
- Products are covered by the manufacturer’s warranty only, if any. We do not offer additional warranties.
- Warranty eligibility may require proof of professional installation, proper maintenance, and use within specified conditions.
- We can assist with warranty claim initiation per manufacturer procedures; approval decisions rest with the manufacturer.
9) Use & Compliance
- You are responsible for selecting products that fit your application and for compliance with local codes, permits, and licensing requirements.
- Some products may be subject to handling, transport, or refrigerant regulations (e.g., EPA 608). You represent that you meet any required qualifications.
- Products are intended for use in the U.S. Export may be restricted by law.
10) Intellectual Property
All site content—including text, product data, graphics, logos, and design—is the property of HVACProSales.com or its licensors and is protected by intellectual property laws. You may not copy, reproduce, or use materials without prior written permission.
11) Prohibited Activities
- Unlawful, fraudulent, or abusive use of the site or Services.
- Tampering with security features or attempting unauthorized access to systems.
- Resale or redistribution in violation of manufacturer policies (including MAP or channel restrictions).
12) Limitation of Liability
To the fullest extent permitted by law, HVACProSales.com and its affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, arising from the use or inability to use products or Services. Our total liability is limited to the amount you paid for the product giving rise to the claim.
13) Indemnification
You agree to defend, indemnify, and hold harmless HVACProSales.com and its affiliates from claims arising out of your misuse of the site, violation of these Terms, or infringement of any third-party rights.
14) Account Security
- You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
- Notify us immediately of suspected unauthorized access. We may suspend or terminate accounts for violations of these Terms.
15) Privacy
Your use of the site is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information.
16) Third-Party Links
Links to manufacturer resources, carriers, or partners are provided for convenience. We do not control and are not responsible for the content or practices of third-party sites.
17) Governing Law & Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any disputes shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida.
18) Changes to Terms
We may update these Terms from time to time. Changes take effect upon posting to this page. Your continued use of the site after updates constitutes acceptance of the revised Terms.
